BETTER BY DESIGN

Please ensure that you read the following terms and conditions prior to placing your order with us.

1. Interpretation

In these terms and conditions:-

“We” and “us” UK Trade Composite Wood Limited

“You” means the person ordering the goods subject to these terms and conditions

2. Your contract is with “the company” UK Trade Composite Wood Limited

  1. These terms and conditions apply to all goods supplied by us to you.
  2. All orders are subject to acceptance by the company and no contract exists between you and us for the sale of any goods until we have received and accepted your order with full or part payment and we have provided you with confirmation in writing or by email to the address you have supplied. Only when you have received our confirmation of your order does a binding legal contract exists between both parties.
  3. We reserve the right to change the terms of sale without notice or prejudice to you in relation to all future sales.

2. Description and price of the goods

  1. All goods are fully described on our web site. We reserve the right to change the product for an alternative but will ensure it meets with a similar or better quality specification. All prices include VAT where applicable. If you require further information or clarification please contact us prior to ordering.
  2. Your order will be manufactured to your specification. You will be provided with pre manufacture documents with the design and specification of your goods for your approval. Following your verbal or email approval no further alterations can be catered for as you are responsible for signing off the final pre-production designs.
  3. We will endeavour to ensure that our web site and other social media platforms contain the most up to date prices at all times. In the unlikely event of a pricing error we reserve the right to notify you as soon as possible and offer you the option to continue with your order at the correct price or give you the option to cancel your order where a full refund will be provided.  If a refund is required, the refund will be processed within 30 days from the original order received.
  4. Delivery is free throughout the UK (Mainland Only). (Excludes Scotland & Northern Ireland)

3. Payment

  1. Payment can be made by providing your debit/credit card details or by bank transfer. All orders are processed on receipt of cleared funds only and if payment is made by cheque, you should allow a further five to seven working days for your payment to be received and to clear.
  2. All major Debit & Credit cards are accepted but whilst debit card do not incur transaction fees there may be a small additional charge for the processing of credit card payments. We reserve the right to change whatever payment processing facilities at any time.
  3. We will take staged payments for your purchase and these will be shown on your order form. As we provide a service at each stage there are no refunds following the provision of said service which commences on the receipt of your initial deposit.
    Stage(1) Initial deposit, where the order is agreed and base plans and drawings provided. Once this order has been accepted by you no deposit refund can be made. It your full responsibility to check that what you have ordered is correct for installation. If in any doubt, it is suggested you source the services of a suitably qualified professional to advise you on said design.
    Stage (2) Pre manufacture plans and specifications are drawn up with our production department. This is the final opportunity for you to make alterations to the specification of your order. Some changes may result in the need for a re-pricing prior to your final sign off. Half the balance is payable as part of the sign off of your pre-production plans.
    Stage(3) Delivery dates once agreed are not transferrable unless a minimum of 14 days notice is given by you. Failure to accept the goods on the agreed date of delivery or failure to pay the remaining balance may result in the goods being returned to the supplier. Late cancellations will incur an additional administrative charge of £250.
  4. Under no circumstances will cash or cheque be accepted on the day of delivery. All funds must be cleared prior to delivery.

4. Delivery

  1. All delivery dates quoted are intended as an approximate guide only.
  2. We will endeavour to deliver your order on the agreed delivery date and will notify you of any delay expected. If your order is not delivered as arranged, we cannot be responsible for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.
  3. The delivery will be made the nearest suitable point for access by the delivery vehicle which will normally be a 7.5 ton box vehicle or larger.  If the site is not accessible by our vehicle it is your responsibility to accept the delivery at the nearest available point and to provide onward transport to your site.
  4. You must supply appropriately skilled labour to offload your order and to check & sign the delivery note.  If we are unable to deliver your order because no-one is present to receive the delivery we will make arrangements for re-delivery at additional cost.  If for any reason we are unable to offload your goods on the agreed delivery date, we reserve the right to apply a charge of £250 for their return and offloading at the factory, reloading and redelivery.
  5. We will normally deliver your order in one complete delivery but reserve the right to make deliveries in instalments prior to the agreed delivery date.
  6. Risk for the goods will pass to you once your order has been delivered and we cannot be responsible for loss or damage once you have received your order. It is your responsibility to check all items against the delivery note and advise the driver of anything missing or broken. Any missing or broken items not brought to our attention within 5 days of delivery will not be replaced without charge.
  7. Time lines for build completions are guidelines only and we accept no responsibility for reasonable delays.
  8. It is your responsibility to ensure that you make the final balance payment prior to the date of delivery to ensure goods are racked and stacked on the lorry the day before. Please contact us to confirm which card details are to be used in each case.
  9. All goods remain the property of UK TRADE CONSERVATORYS LTD until full payment is received from the customer and those fund have been cleared.

5. Liability

    1. If any goods received are damaged or defective or your order has been delivered incorrectly you should notify us as soon as possible but you must notify us within 5 working days in writing.
    2. Any goods that have been installed cannot be returned unless faulty.
    3. If you notify a problem to us under this clause, we will at our discretion:
      (a) Make good any shortage or non-delivery
      (b) Replace or repair any goods that are damaged or defective
    4. We cannot be held liable to you for any indirect or consequential loss, damages or expenses arising out of a problem you notify to us under this condition. We shall bear no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the specific parts in question under clause ii) above.
    5. Our products are supplied for self-installation and it is your responsibility to ensure that they are installed correctly. Whilst we provide information to assist you in the installation of your goods, we cannot be liable to you for any loss or damage arising from information we have provided regarding installation. UKTCW are a supply only company and we do not install ourselves directly.
    6. Customers who have placed an order, and had it confirmed by us, will upon your request recommend a installation/fitting company from our preferred list of installers in your area. They will provide a no obligation quote free of charge for your build/installation requirements. All subsequent work agreed in relation to the installation of your goods is between yourself and your installer.
    7. UKTCW will have no involvement or bear any responsibility regarding any work undertaken by any installation company in relation to goods we have supplied.
    8. These terms and conditions are in now way intended to limit any statutory rights you may have as a consumer that cannot be excluded by law nor to exclude or limit our liability to you for death or personal injury resulting from our negligence.

6. Returns Policy

  1. i) All of our goods are supply only and are made to your approved specification as part of the pre-manufacture process. Your right to cancel following your written approval is subject to your contract with us and failure to meet those obligations may result in financial penalties. Cancellation can only occur as specified in clause 2(iii) above.

7. Order Acceptance & Subsequent Requests For Change

  1. All of our goods are made and supplied to order. All orders will be emailed direct to you and should be confirmed within 72 hours of receipt in support of our pre-production process and timescales for manufacture and delivery. If not confirmed within the stated time those plans are assumed to be  acceptable by you the customer.
  2. Production will raise the pre manufacture plans and send them to you for your final approval. We will not commence manufacture of your goods until you have approved your pre manufacture plans.
  3. Thereafter, once production of the components for your order has commenced, any changes in specification or cancellation will result in additional charges for any components that have or are in the process of being manufactured and cannot be reused elsewhere.

8. Guarantee

  1. All goods supplied by us are manufacture guaranteed as follows:
  2. This Guarantee is not transferable and is provided on the basis that the goods have been correctly installed and maintained in accordance with our instructions.
  3. This Guarantee does not affect any statutory rights you have as a consumer.
  4. Excluded from this Guarantee is any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence, faulty installation by you or any third party, or any alteration or repair carried out without our approval.
  5. Should any goods supplied by us to you develop a defect under guarantee you should notify us in writing as soon as possible.
  6. Where we replace any item under guarantee we reserve the right to arrange (at our cost) for the return of the original item.

9. Data protection

  1. We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for unauthorized access to information supplied by you.
  2. We agree to use the information you have provided about yourself for the purpose of fulfilling your order. No data will be shared with third party companies without your expressed permission.
  3. We will not sell or give your details to any third parties for marketing purposes.

10. Applicable law

  1. These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

11. Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

12. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you)

The Enforceability of any other parts of these conditions will not be affected.

13. Entire agreement

These terms and conditions, together with our current web site prices, specifications, delivery details and contact details set out the whole of the agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

14. Third Party Rights

Except for our directors, employees or representatives, a person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

15. Third Party Services:

UK TRADE COMPOSITE WOOD LTD are a supply only company. We do not install any of our products directly ourselves. For our customers who have ordered from us we have a recommended list of nationwide “preferred” installers.

Once you have placed your order deposit we can at your request refer you to one of these companies. They will contact you directly and discuss building & installation requirements for your project. They are totally familiar with our products an have carried out many installations/building work for many of our customers across the UK. All of their work is insurance backed guaranteed work and subject to a  site survey for a small charge that will be deducted from the final invoice on completion of all works.

All building/install/survey work carried out by any of our referral partners is assumed to be between you the customer and the referral company. Any monies for such work will be between both parties and any remedial work/service calls etc will be between you both.

UK TRADE COMPOSITE WOOD LTD will accept no responsibility for any agreements/orders/service issues between you and any third party referred company that we might recommend.
